The Court of Arbitration for Sport (CAS) in Lausanne, Switzerland, has dismissed Royal AM’s appeal against the promotion of Sekhukhune United from the GladAfrica Championship to the Premier Division at the end of last season.

Thwihli Thwahla challenged Babina Noko’s automatic promotion after they were deducted points last season.

In its ruling, CAS said it had no jurisdiction to hear Royal AM’s appeal, which the Durban club filed in September last year.

The CAS also ordered Thwihli Thwahla to bear the yet-to-be-deternined costs of the arbitration. Thwihli Thwahla will also pay the legal fees – R63 631,23 – of both the National Soccer League (NSL) and Babina Noko.

The ruling was signed by president of the panel Luigi Fumagalli as well as arbitrators David Phillips and Rauf Soulio.
