Members of the previous board of Boxing South Africa (BSA) withheld very important information when they appeared before parliament’s portfolio committee on sport, arts and culture last month. 

The previous board told the portfolio committee that a settlement had been reached with former BSA chief executive officer Moffat Qithi. However, the members conveniently forgot to tell the portfolio committee about a Qithi case at the Labour Court of South Africa in Johannesburg.  

And to prove that they lied, Madam Justice Phehane of the Labour Court of South Africa in Johannesburg ruled on Tuesday last week that the settlement concluded between BSA and Qithi on 27 June 2023 had been made a court order.

And on Thursday, 14 December 2023, – the previous BSA board instructed Masilo Maake Attorneys to challenge the Labour Court ruling. That was three days after the previous board’s term had ended. 

“The above-mentioned applicant intends to apply to this honourable Court for leave to appeal to the Labour Appeal Court against the whole judgment of Her Ladyship Phehane delivered on the 12th December 2023, on the following grounds of fact and law. The Court a quo, erred in finding the application of First Respondent is urgent. The court a quo, should instead have found that the matter was not properly before Court in that the First Respondent had not alleged that the matter was urgent. The First Respondent had not asked for condonation of non-compliance with the rules regarding service and notice. The Court a quo erred in exercising its discretion in favour of the First Respondent where the matter was not properly placed before Court.”
