Judge Roland Sutherland of the Gauteng High Court dismissed GladAfrica Championship side Royal AM’s application for leave to appeal his decision to uphold Advocate Hilton Epstein’s arbitration award of three points to Sekhukhune United.
Sekhukhune were awarded three points after Polokwane City failed to have five Under-23s in their match day squad earlier this year. They have now gained automatic promotion to the Premier Division.
Judge Sutherland also ruled that costs incurred by Sekhukhune United in participating in the leave to appeal will be borne by Royal AM.
He went on to rule that costs incurred by the South African Football Association (SAFA) and the National Soccer League (NSL) shall be borne by each body.
